Manitoba company fined after tire pins worker in accident

A Manitoba company has been fined $25,000 after a worker was injured three years ago when he was pinned by a falling tire.

On May 17, 2021, a serious incident occurred in Rosenort in the Rural Municipality of Morris at K-Tec Earthmovers Inc., a manufacturer of heavy-duty earth-moving scrapers for construction, agriculture and mining sites around the world. A forklift operator, while unloading tires with the assistance of another worker, encountered a critical safety failure. The workers manually rolled tires out of a container, tipping them onto forklift forks for transfer to a skid. The worker was rolling out a tire when a tire from the row behind suddenly fell forward, crushing the worker against the container floor. A forklift was used to remove the tire from the injured worker.

The worker suffered compression fractures in their back and neck and briefly lost consciousness.

An investigation by Workplace Safety and Health officials following the incident led to charges being laid under the Workplace Safety and Health Act. On Feb. 22, K-Tec Earthmovers pleaded guilty to section 2.1.1(a) of the regulation, specifically for failing to develop and implement safe work procedures for tasks performed at the workplace.

As a result of the plea, the court imposed a fine of $25,000 on K-Tec.

“Manitoba Labour and Immigration is reminding employers to develop and implement safe work procedures for work that is done at the workplace after an employer was prosecuted under the Workplace Safety and Health Act,” the province said in a release Friday.
